Terms of Use

These Terms of Use (“Terms”) govern your use of the Bernice™ browser extension and related materials (“Bernice”), provided by Western Workshops (“we”, “us”). By installing or using Bernice, you agree to these Terms. If you do not agree, do not install or use Bernice.

1. What Bernice does. Bernice reads the conversation shown on supported AI chat websites in your browser and saves a copy as files in a folder you choose on your own computer. Bernice works entirely on your device. It does not send your conversations to us or to anyone else.

2. Licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Bernice for your own personal or internal business purposes, subject to these Terms.

3. Restrictions. You may not: (a) copy, modify, adapt or create derivative works of Bernice, except as the law expressly allows; (b) sell, resell, rent, sublicense, distribute or publish Bernice or any part of it; (c) remove or alter any copyright, trademark or other notices; (d) use Bernice’s name, artwork or likeness without our written permission; (e) use Bernice in violation of any law, or of the terms of the AI services you use with it.

4. Your responsibilities. You are responsible for your saved files, your storage folder, and your own backups. Bernice records the text of conversations. It does not save, download or back up files that you attach or that an AI service creates; it notes only their names. Keeping copies of those files is your responsibility. Bernice can only record what appears as text on the page; for example, it cannot record voice conversations that are not shown as text, or messages that never reached the AI service. You are responsible for complying with the terms of the AI services you use, and with any laws that apply to recording, storing or sharing the content of your conversations, including content provided by others.

5. No guarantee of complete recording. Bernice is designed to record conversations reliably and to tell you when it cannot. However, AI services change their websites without notice, and computers, browsers and storage can fail. We do not guarantee that every message will be recorded, complete, accurate or recoverable. Do not rely on Bernice as your only copy of important information.

6. Third-party services. Bernice works with websites operated by others, such as ChatGPT, Claude and Gemini. We do not control those services, and changes to them may affect how Bernice works. Bernice is not affiliated with, endorsed by or sponsored by OpenAI, Anthropic, Google or any other AI provider.

7. Disclaimer of warranties. BERNICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WESTERN WORKSHOPS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, WORK, PROFITS OR BUSINESS, ARISING FROM OR RELATED TO BERNICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO BERNICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR BERNICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50.

9. Updates and changes. We may update Bernice and these Terms from time to time. If we make material changes to the Terms, we will post the updated Terms here with a new effective date. Continued use after changes means you accept them.

10. Ending use. You may stop using Bernice at any time by removing it from your browser. Your saved files remain on your computer. We may end your licence if you breach these Terms.

11. Governing law. These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules.
